1. The Contract
The contract is between INNER PACHA Tour Operator (hereinafter referred to as “the Company”) and the client, who is the person traveling or attempting to travel on a tour operated by the Company. You, the client, declare that you have read and understood our travel policy as set forth below. By making a reservation by phone, through the website, or by email, you accept and are bound by these Terms and Conditions. These constitute the entire agreement between the Company and the client regarding the subject matter herein and form a binding agreement. There is no verbal or written representation, warranty, prior agreement, description of services, conditions, or promise of refund that is not expressly stated herein. The service to be provided shall be the tour(s) mentioned in the booking confirmation.
These conditions apply only to services in our program and not to international or domestic flights, which are subject to the conditions imposed by the airlines.
2. Securing Your Reservation
To secure the reservation, INNER PACHA Tour Operator requires a completed booking form (either from our website or the one sent by us with your quote), along with the required deposit payment. The recommended time to make your reservation is 60 days before your trip to Peru. A reservation is accepted and becomes final only from the date the deposit is received, at which time a contract exists. INNER PACHA Tour Operator reserves the right to reject any reservation at its discretion.
3. Client Information
To confirm and guarantee the organization of the trip, the client must provide all their identification information with the initial payment, or no later than 60 days before the start of the trip. Client information includes: passport number, copy of passport data, medical form (when applicable), full name, date of birth, international flight information, nationality, and contact phone number (landline or mobile) for emergencies.
4. Final Payment / Surcharges
For the Company to confirm the organization of the trip, the client must provide all their information along with the final payment at the start of the tour.
Surcharges: To avoid surcharges on your vacation, make your reservation in advance and do not change hotels at the last minute.
5. Changes and Cancellation by the Client
An administrative fee of USD 50.00 per person will be charged if the confirmed reservation is changed or transferred to a different departure date or tour, provided this is done up to 30 days before the trip. After that deadline, all changes will be treated as cancellations and will be subject to corresponding charges.
If a client is unable to travel and notifies us at least 20 days in advance, under circumstances that INNER PACHA Tour Operator considers reasonable, their money will be refunded less 20% (10% for bank transfer fees and 10% for administrative expenses). The refund will be made within less than 15 days. Transferring the reservation to another person is not permitted.
6. Changes by the Company
The Company reserves the right to modify any of the facilities, services, or prices described in the brochure or on the website. If any change is made, the client will be informed at the time of booking or when the change occurs. While the Company will strive to operate all tours as announced, reasonable changes to the itinerary may be made when the Company deems it necessary or convenient due to external factors beyond its control.
7. Cancellation by the Company
INNER PACHA Tour Operator reserves the right to cancel any trip before its operation is guaranteed, but will not cancel a trip less than 30 days before departure. Your trip is guaranteed to operate unless the minimum number of participants indicates otherwise, or factors outside INNER PACHA Tour Operator’s control occur. This applies to departures within the brochure’s validity period.
Note: Airlines may impose 100% cancellation charges.
8. Complaints
If the client has a complaint about any of the tour arrangements, it is a condition of the contract that they inform our local representative at that time. If they do not file the complaint at that time, they will deny us the opportunity to investigate and rectify the problem, and INNER PACHA Tour Operator will not be able to accept any liability. If the client has a dispute with INNER PACHA Tour Operator and cannot resolve it, they must write to us within 28 days of their return, and we will continue with the investigation.
9. Travel and Cancellation Insurance
Travel insurance is highly recommended for all clients. We recommend that it covers personal injury, medical expenses, repatriation expenses, evacuation expenses, cancellation, and trip curtailment. It is our policy to verify the validity and coverage of your insurance policy, and we reserve the right to deny transportation to any person whose insurance does not meet these criteria. If you decide not to purchase travel insurance, you will be required to sign a waiver form acknowledging that insurance is recommended but was declined, and that in the event of a need for changes, trip cancellation, or medical expenses, the client will be responsible for all additional costs.
10. Financial Security
INNER PACHA Tour Operator is a travel agency accredited by the Ministry of Tourism and registered as a limited liability corporation. INNER PACHA Tour Operator complies with current European standards regarding the protection of client funds.
11. Client Responsibility
The client agrees to accept the authority and decisions of INNER PACHA Tour Operator’s employees, tour leaders, and agents during their vacation. If, in the opinion of these individuals, the client’s health or conduct at any time (before or after departure) appears to endanger the safety, comfort, or tranquility of the tour, the client may be excluded from all or part of the tour.
Clients must be in possession of their respective identification documents and are responsible for carrying a valid passport with visa, where applicable. Their passport must be valid for at least 6 months after the return date.
12. Our Responsibilities
Reservations are accepted with the understanding that the client appreciates the possible risks inherent in adventure travel and that the visits, excursions, or expeditions included in our programs are undertaken at their own will. It is also important to understand that even the most meticulous arrangements can go wrong.
The Company undertakes to provide its services with the necessary diligence so that the trip goes as smoothly as possible, and we will strive to serve you as best we can.
The Company assumes no responsibility whatsoever for force majeure, climatic or natural phenomena that may occur before or during the trip, nor for any eventuality that may make the trip uncomfortable or difficult, nor for delays or obstructions of the trip in any way. The Company does not guarantee the total or partial execution of the contracted services when they have been affected by the aforementioned factors.
13. Flights / Delays
We accept no responsibility for cancellations or delays of your flights if such cancellation or delay is due to adverse weather conditions, airline rescheduling, airport authority decisions, air traffic controller actions, mechanical failures, or industrial action.
Our Company will strive to resolve your travel itinerary so that no inconvenience affects the service. The client must understand and be flexible, as if the air delay prevents resolving the issues, the Company assumes no responsibility.
14. Child Policy
In all programs, unless otherwise indicated, the maximum age for a passenger to be considered a child is 11 years and 11 months. Those over 12 years of age are considered adults and will be subject to adult rates.
15. Last-Minute Reservations
For all reservations made within 10 days of departure, an additional fee of USD 50.00 will apply. This last-minute fee covers our additional costs with hotel providers, train tickets, bus tickets, and operating expenses.
I hereby declare that I have read and understood the Terms and Conditions set forth above, as well as the sales conditions as indicated by the Company on the website, brochure, or provided form, and I am fully aware that my signature confirms this statement.
