INNER PACHA Tour Operator
1. THE CONTRACT
This contract is entered into between INNER PACHA Tour Operator (hereinafter referred to as “the Company” or “INNER PACHA”) and the client (hereinafter referred to as “the Client”), with the Client being understood as any individual who travels or attempts to travel on a tour operated by the Company.
By making a reservation by phone, through the official website, by email, or through any other means offered by the Company, the Client expressly and unequivocally declares that they have read, understood, and accept all of these Terms and Conditions, which become an integral part of the binding agreement between the parties.
These Terms and Conditions constitute the entire agreement between the Company and the Client regarding the contracted services, and prevail over any communication, verbal or written representation, warranty, prior agreement, description of services, or promise of refund not expressly set forth in this document.
The service to be provided shall be exclusively the tour or tours detailed in the booking confirmation issued by INNER PACHA.
Scope Limitation: These conditions apply only to services included in INNER PACHA’s program. They do not apply to international or domestic flights, which are subject exclusively to the general conditions of carriage imposed by each airline.
2. BOOKING
To secure a booking, the Client must:
a) Complete the booking form available on INNER PACHA’s official website or the one sent by the Company along with their personalized quote;
b) Make the corresponding deposit payment as indicated in the quote.
The recommended time to make the booking is 60 (sixty) days before the start date of the trip to Peru. Once the deposit is received, the booking will be considered accepted and final, at which point a binding contract exists between the parties.
INNER PACHA Tour Operator reserves the right to reject any booking, in whole or in part, at its sole discretion and without the need for justification, in which case any amount paid by the Client shall be fully refunded.
3. CLIENT INFORMATION
To confirm and guarantee the proper organization of the trip, the Client must provide all their identification information together with the initial payment, or no later than 60 (sixty) days before the start of the trip.
Required information includes, but is not limited to:

Passport number

Legible copy of the passport data page
-
Completed medical form (when applicable)
-
Full name (as it appears on the passport)
-
Date of birth
-
International flight information (flight numbers, dates, and times)
-
Nationality
-
Contact phone number (landline and/or mobile) for emergencies
Failure to provide such information in a timely manner may result in cancellation of the booking without refund.
4. FINAL PAYMENT AND SURCHARGES
The Client must provide all of their personal information together with the final payment at the start of the tour, as established in the booking confirmation.
Surcharges: To avoid additional surcharges on their vacation, the Client must make their booking well in advance and refrain from changing hotels or modifying contracted services close to the start date of the trip. Any last-minute modification may generate surcharges not specified in the original quote, which will be communicated to the Client in advance.
5. CHANGES AND CANCELLATION BY THE CLIENT
5.1 Changes requested by the Client
An administrative fee of USD 50.00 (fifty US dollars) per person will apply when the Client requests a change to the confirmed booking (departure date, tour type, or any other substantial modification), provided that such request is received by the Company at least 30 (thirty) days in advance of the trip start date.
Change requests received less than 30 days in advance will be treated as cancellations and will be subject to the charges set forth in section 5.2.
5.2 Cancellation due to inability to travel
If the Client is unable to travel and provides documented notice to INNER PACHA at least 20 (twenty) days in advance, provided that such inability is deemed reasonable by the Company, the paid amount will be refunded, deducting 20% (twenty percent) of the total amount, broken down as follows:

10% for bank transfer fees

10% for administrative expenses
The refund will be made within no more than 15 (fifteen) business days from the date of cancellation notice.
Transfer of the reservation to another person is not permitted under any circumstances.
5.3 No-show
If the Client fails to appear at the start of the tour without having previously notified their cancellation, they shall not be entitled to any refund.
6. CHANGES BY THE COMPANY
INNER PACHA Tour Operator reserves the right to modify any of the facilities, services, or prices described in its brochure, website, or promotional materials.
If any modification occurs, the Client will be informed in a timely manner, either at the time of booking or when the change occurs, as applicable.
While the Company will make its best efforts to operate all tours as announced, reasonable changes to the itinerary may be introduced when the Company deems it necessary or convenient due to external factors beyond its control (weather conditions, closures of tourist sites, strikes, government measures, among others).
7. CANCELLATION BY THE COMPANY
INNER PACHA Tour Operator reserves the right to cancel any trip before its operation is guaranteed. However, the Company will not cancel a trip less than 30 (thirty) days before the departure date, except for reasons of force majeure or unforeseeable circumstances.
The trip is guaranteed to operate, unless:
a) The required minimum number of participants is not reached (duly informed to the Client prior to booking); or
b) External factors beyond INNER PACHA’s control occur that objectively prevent the provision of the service.
In the event of cancellation by the Company (other than for force majeure), the Client shall be entitled to a full refund of all amounts paid.
Note: Airlines may impose 100% cancellation charges on the value of the air ticket, which are not the responsibility of INNER PACHA.
8. COMPLAINTS
It is an essential condition of this contract that if the Client has a complaint about any of the tour arrangements, they must immediately inform our local representative at the place and time the incident occurs.
Failure to file a timely complaint at the destination will prevent the Company from investigating and rectifying the problem, and therefore INNER PACHA will not accept any liability for complaints filed after the conclusion of the tour.
If the Client is unable to resolve their dispute directly with the local representative, they must submit their claim in writing to INNER PACHA’s offices within 28 (twenty-eight) days following their return date. Once the claim is received, the Company will proceed with its investigation and provide a response within a reasonable period.
9. TRAVEL AND CANCELLATION INSURANCE
Travel insurance is mandatory and highly recommended for all clients. The policy must cover, as a minimum:

Personal injury
-
Medical expenses (including hospitalization)
-
Repatriation expenses
-
Emergency evacuation expenses
-
Trip cancellation
-
Trip curtailment or interruption
INNER PACHA reserves the right to verify the validity and coverage of the Client’s insurance policy, as well as to deny transportation or participation in the tour to any person whose insurance does not meet the minimum criteria established in this clause.
If the Client voluntarily decides not to purchase travel insurance, they must sign an express waiver form, whereby they:

Acknowledge that insurance was recommended by the Company

Accept that they travel at their own risk
-
Assume full responsibility for all additional costs arising from cancellations, changes, medical expenses, evacuation, repatriation, or any other event that would be covered by travel insurance
10. FINANCIAL SECURITY
INNER PACHA Tour Operator is a travel agency duly accredited by GERCETUR and registered as a limited liability corporation.
The Company declares that it complies with current European standards regarding the protection of client funds, implementing the necessary financial measures to safeguard funds received for bookings and payments.
11. CLIENT RESPONSIBILITY
The Client agrees to:
a) Accept the authority and decisions of INNER PACHA’s employees, tour leaders, and agents during their vacation;
b) Comply with all safety rules, schedules, and instructions given by the Company’s staff.
Exclusion due to health or conduct: If, in the reasoned opinion of INNER PACHA’s staff, the Client’s physical or mental health, or conduct, at any time (before or after departure), poses a danger to the safety, comfort, or tranquility of the group or the tour, the Company may exclude the Client from all or part of the tour, without refund.
Documentation: The Client is solely responsible for:

Being in possession of all their identification documents (passport, visas, permits)

Carrying a passport with minimum validity of 6 (six) months after the return date
-
Obtaining any vaccines required by Peruvian or international authorities
Lack of proper documentation shall not be the responsibility of INNER PACHA and shall not entitle the Client to a refund.
12. COMPANY RESPONSIBILITIES
Bookings are accepted with the understanding that the Client:

Appreciates and accepts the inherent risks of adventure travel (hiking, high mountains, extreme weather conditions, rough terrain, etc.)
-
Undertakes the visits, excursions, or expeditions included in the programs at their own will
-
Understands that even the most meticulous arrangements may be affected by unforeseen circumstances
INNER PACHA undertakes to provide its services with due diligence and to make its best efforts to ensure the trip proceeds satisfactorily.
Limitation of Liability: The Company assumes no responsibility whatsoever for:

Force majeure events (wars, strikes, terrorism, natural disasters, epidemics, pandemics)
-
Climatic or natural phenomena occurring before or during the trip
-
Any eventuality that makes the trip uncomfortable, difficult, or dangerous
-
Delays or obstructions of the trip for any reason beyond the Company’s control
-
Total or partial execution of services when they have been affected by the aforementioned factors
13. FLIGHTS AND DELAYS
INNER PACHA accepts no responsibility whatsoever for cancellations, delays, rescheduling, or any other irregularity in domestic or international flights, when such circumstances are caused by:

Adverse weather conditions
-
Airline rescheduling or operational decisions
-
Airport authority decisions
-
Air traffic controller actions
-
Mechanical failures of aircraft
-
Industrial action (strikes, work stoppages)
The Company will make its best efforts to readjust the travel itinerary and minimize the impact of such delays. However, the Client agrees to be flexible and understanding, acknowledging that certain flight delays may make it impossible to fully recover the original itinerary.
14. CHILD POLICY
For all programs offered by INNER PACHA, unless expressly stated otherwise:

A “child” is defined as any passenger up to and including 11 years and 11 months of age
-
Passengers 12 years of age or older are considered adults and will be subject to adult rates and conditions
The Company may request documentation proving the minor’s age.
15. LAST-MINUTE RESERVATIONS
Any booking made within 10 (ten) days prior to the departure date will be considered a “last-minute reservation” and will be subject to an additional fee of USD 50.00 (fifty US dollars).
This fee covers the additional operational costs incurred by the Company in managing with suppliers (hotels, issuance of train tickets, bus tickets, guides, etc.) under reduced timeframes.
16. FINAL PROVISIONS
Acceptance: By making the booking and/or paying the deposit, the Client declares that they have read, understood, and fully accept these Terms and Conditions.
Amendments: INNER PACHA reserves the right to amend these Terms and Conditions at any time. Amendments will be published on the official website and will not affect already confirmed bookings.
Applicable Law: This contract is governed by the laws of the Republic of Peru.
Jurisdiction: Any dispute arising from this contract shall be submitted to the jurisdiction of the ordinary courts of the city of Lima, Peru, with the parties waiving any other jurisdiction that might correspond to them.
